These Terms and Conditions ("Terms") govern your access to and use of the website at bioconnecthealth.com and the telehealth services provided by **BioConnect Health** and its affiliated professional medical practice(s) and licensed providers (collectively, "BioConnect," "we," "us," or "our"). By accessing our website or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Please also review our **Privacy Policy**, **Notice of Privacy Practices**, **Refund Policy**, and **Shipping Policy**, which are incorporated by reference.
1. Not Medical Advice; No Provider–Patient Relationship Through the Website
The content on our website is provided for **general informational and educational purposes only** and does not constitute medical advice, diagnosis, or treatment. Using the website, submitting a consultation request, or reading our content **does not create a provider–patient relationship**. A provider–patient relationship is formed only after you complete an intake, are evaluated by a licensed provider, and are accepted for care.

2. Eligibility
To use the Services, you must be **at least 18 years old**, reside in a state where our providers are licensed and where telehealth law permits, and be able to enter into these Terms. Services, medications, and protocols may not be available in all states.
3. Telehealth Consultations
Consultations are conducted via telehealth. By using the Services, you consent to receive care through telehealth and acknowledge you have reviewed and agreed to our **Informed Consent to Telehealth**. You agree to provide accurate, complete, and current health information. Inaccurate or incomplete information may affect the safety and appropriateness of your care.

Telehealth has inherent limitations, including that a provider cannot physically examine you. Your provider will determine whether telehealth is appropriate for you and may decline to provide services or may recommend in-person care.
4. Medical Services, Provider Discretion, and No Guarantee of Treatment
All medical services are provided by **licensed healthcare professionals** exercising independent clinical judgment. Whether any particular treatment, medication, protocol, or dose is appropriate is determined solely by your provider based on your medical history, lab results, and evaluation.

**Submitting a request or payment does not guarantee that you will be prescribed any medication or accepted for treatment.** Your provider may determine that a requested therapy is not appropriate for you.
5. Off-Label Use, Compounded Medications, and Controlled Substances
You acknowledge and agree that:

- Some medications and peptides may be prescribed for **off-label uses** — uses not specifically approved by the U.S. Food and Drug Administration — based on your provider's clinical judgment and in accordance with applicable law.
- Certain peptides and medications are **not FDA-approved** and/or are **compounded** by licensed compounding pharmacies. Compounded medications are not FDA-approved and are not reviewed by the FDA for safety, effectiveness, or quality in the same manner as FDA-approved drugs.
- Certain therapies (including hormone therapies such as testosterone) may be **controlled substances** and are prescribed and dispensed only for legitimate medical purposes in compliance with federal and state law.
- These therapies carry potential **risks and side effects**, which your provider will discuss with you. You agree to follow all provider instructions, complete required lab testing and monitoring, and promptly report side effects.

**The Services and any therapies are not intended to diagnose, treat, cure, or prevent any disease. Individual results vary, and no specific outcome is guaranteed.**
6. Lab Testing and Monitoring
Lab testing may be required to establish eligibility and to guide and monitor treatment. You agree to complete required labs and follow-up as directed. Failure to complete required monitoring may result in discontinuation of therapy.
7. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. Account access is personal to you and may not be shared.
8. Fees, Memberships, Subscriptions, and Cancellation
Fees for consultations, memberships, subscriptions, medications, lab kits, and other items are as presented at the time of purchase. If you enroll in a recurring membership or subscription, you authorize us (through our payment processor) to charge your payment method on a recurring basis until you cancel. Recurring charges renew automatically unless cancelled in accordance with the cancellation instructions provided at enrollment and consistent with applicable auto-renewal laws. Refunds and cancellations are governed by our **Refund Policy**. Shipping is governed by our **Shipping Policy**.

Because prescription medications are personalized and dispensed for you, they are generally **non-returnable and non-refundable** except as required by law or as stated in our Refund Policy.
9. Shipping and Home Administration
Lab kits, medications, and materials are shipped to the address you provide. You are responsible for providing a correct, secure delivery address and for the safe storage of shipped items. Where medications are self-administered (for example, by subcutaneous injection), you agree to follow all provider and product instructions and to use and dispose of supplies safely.
10. Acceptable Use
You agree not to misuse the website or Services, including by providing false information, sharing or reselling medications, accessing the Services from a state where they are not offered by misrepresenting your location, interfering with the operation or security of the Services, or infringing the rights of others.
11. Intellectual Property
The website and its content, including text, graphics, logos, and trademarks (including the BioConnect Health name and logo), are owned by or licensed to us and are protected by applicable law. You may not copy, reproduce, or use our content or marks without our prior written permission, except as permitted for your personal, non-commercial use of the Services.
12. Third-Party Services
We work with third parties such as pharmacies, laboratories, payment processors, and shipping carriers. Your interactions with these third parties may be subject to their own terms, and we are not responsible for their acts, omissions, products, or services except as required by law.
13. Disclaimers of Warranties
EXCEPT AS EXPRESSLY PROVIDED AND AS REQUIRED BY LAW, THE WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT ANY THERAPY WILL ACHIEVE A PARTICULAR RESULT. THIS SECTION DOES NOT DISCLAIM ANY PROFESSIONAL DUTY OF CARE OWED BY A LICENSED PROVIDER TO A PATIENT, WHICH IS GOVERNED BY APPLICABLE LAW.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AND EXCEPT FOR LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW (INCLUDING A PROVIDER'S PROFESSIONAL LIABILITY), BIOCONNECT AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE WEBSITE OR THE INFORMATIONAL CONTENT PROVIDED, AND OUR TOTAL AGGREGATE LIABILITY FOR SUCH MATTERS WILL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
15. Indemnification
You agree to indemnify and hold harmless BioConnect and its affiliates, officers, and employees from claims, damages, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Services or medications, your provision of inaccurate information, or your violation of law, except to the extent caused by our gross negligence or willful misconduct.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Subject to any applicable law that provides otherwise, the state and federal courts located in Palm Beach County, Florida, will have exclusive jurisdiction, and you consent to venue there.
